GDPR
GDPR stands for US General/General Data Protection Regulation.
On May 25, 2018, a new law on environmental protection was adopted in all member states of the European Union. What is often referred to as the EU General Data Protection Regulation is actually a series of EU directives:
Regulation (EU) 2016/679
Directive (EU) 2016/680
Main Goals of the GDPR
- data protection
- protecting the rights and freedoms of people in protecting their data
- management of data transfer within the use
Basic terms
- The data controller is the one who interacts with the client, collects data and gets how to process it further.
- Processor (Operator) of data – receives personal data from the controller, stores them or decides in some way, according to the specified controller. The processor does not work with external parties, but only requests for their personal data, strictly on behalf of the controller. Under the GDPR, the status of a processor can be lost if the processor begins to determine how to handle the data itself, and does not follow the instructions of the controller.
- Joint controllers – if personal data is processed by two controllers. For example, if the processor changes the scheme of processing natural resources without the knowledge of the controller, then he himself becomes the controller.
- DPO (Data Protection Officer) – data protection officer.
Citizens’ rights
The GDPR protects and introduces new rights for EU citizens, and gives citizens more control over their personal data:
- easier access to the information received includes additional information about how this data is processed and ensures that this information is accessible in a clear and usable way;
- the right to data portability – changing the rules for transferring data between service providers;
- the right to deletion (“the right to data recovery”) – when a person no longer wants his staff to process and there are no legal grounds for storing his data, then the data will be deleted;
- the right to know if a user’s data has been compromised – companies and organizations have been able to increase the speed at which people are informed of a data breach. They are also required to notify the appropriate data protection supervisory authority.
In addition, the GDPR covers the environmental and work tools for EU citizens to exercise their rights, making it easier to seek help from supervisory authorities, such as complaints on electronic devices.
Personal data
Personal data – any information perceived to be an identified or identifiable choice of a person (“data subject”).
For example, directly or indirectly, a person may be identified using an identifier, sample, number selection, location data, any online identifiers, as well as by nature for this individual, traces, genetic, spiritual, economic, cultural tastes, or related with them needs. factors of social identity, etc.
Then all the data that is covered with it is personal data. That is, the data simply becomes personal data, if you use a certain combination of them, an unequivocal disease of a person.
Examples of statistics data:
- First Name Last Name
- Passport number or ID card
- Date and place of birth
- place of residence, registration, registration
- e-mail, phone, or other contact information
- IP addresses and connection parameters
- date and time of the visit, history and parameters of the visit, including the name of the browser.
As well as specially protected data:
- race and nationality
- Political Views
- religion
- sexual orientation
- biometric data – physical, calculated or behavioral features of an individual, with the help of which it is possible to uniquely identify a person. For example, an image of a human face, fingerprints, retinas, voice recording, etc.
- health data – data on the subsequent or mental health of a person. Narpimer, medical tests and presence.
- genetic data – inherited or acquired genetic traits of an individual that have an impact on physiology or health, as well as completely biological features
Data processing principles under the GDPR
Scope of the GDPR
The GDPR covers the fully or partially automated processing of personal data of EU citizens in the European Union and outside it by individuals or legal entities, government agencies and other institutions and organizations. Any, even non-commercial, activity related to the processing of personal data falls under the scope of the GDPR (Article 2, Article 3).
Even gratuitous provision of services to EU citizens falls under the law. For example, if an EU citizen registered on the Internet, and even used it for free, but left some personal data, then this also falls under the GDPR.
For example, even a regular website that accepts visitors from the EU and collects cookies is subject to the GDPR. Although cookies are stored on the user’s computer, this is irrelevant from a GDPR point of view. Since the decision to store or not is made automatically on the server side (controller).
GDPR Compliance
To validate your draft GDPR you should:
- Determine what personal data the project collects, where and how it is present, processed and used. Perhaps not all data is actually required. If it is not possible to determine the identity of a person from the totality of data, then this is not personal data, and then it does not apply.
- Control of the use of natural resources. Determine how, when, by whom and why personal data is processed.
- Develop data protection mechanisms. Security check against hacking. There may be a small number of circles of persons admitted to work with personal data. If necessary, develop policies for access to land data processing.
- Assign data protection to data protection.
- Maintain income income, in accordance with the provisions of the GDPR.
Leakage of personal data
What to do if your site or project is hacked to minimize losses.
